LeGaL FeEs 4 S&P...

BREAKING NEWS:
I just got to know that my owner is a "she" so she is Mrs Owner now.. please excuse me and my always got confuse with chinese name problem... sowwy Mrs Owner... Ni la akibatnya kalau xbersemuka ngn tuan tanah...walhal nk beli umah dia...wakakakaka.. 


Yenneway..today i want to talk about Legal Fees for S&P 



A. LAWYER CHARGERS:
  1. Sale & Purchase Agreement (S&P)
    For 1st RM150k    x 1.0%
    The next RM850k  x 0.7%
  2. CKHT 2A [RM200] approx.
  3. Government Service Tax (6% of no. 1 +no.2)
B. DISBURSEMENT:

  1. Stamp Duty on S&P *
    For 1st RM100k       x 1.0%
    RM101k - RM400k  x 2.0%
  2. Others  [RM800 - RM1,200] approx.
    • Search on Title
    • Developer's Confirmation
    • Registration on MOT
    • Traveling expenses
    • Photostatting, Printing, Telephone, facsimile
 * You may choose to apply for the remittance of 50% stamp duty if you never apply for it.

Example:   
 Purchase Price RM300k
  • Lawyer Chargers RM2,915
    >>S&P          RM2,250
    >>CKHT 2A  RM   200
    >> G.S. Tax   RM   165
  • Disbursement      RM5,980
    >>Stamp Duty   RM5,000

Usually upon appointing the lawyer, you will need to pay the deposit for the lawyer to start processing the documents and the balance to be paid once the S&P has been signed. (Ni semua subject to the lawyer, boleh dibawa berbincang, mine i already told the lawyer i will minus the fee from the loan i'm taking..hehe..)

    Lets Put Some Thoughts

    It has been a WEEK... Finally my Valuation Report is ready for collection.. So apa lagi, cepat2 i suruh my runner, En Hulk bergegas pegi ke office Ms Valuer after lunch td...  and as for my Ms Lawyer pulak, she is currently doing her lawyer-to-lawyer business now.. so nothing much that i can do now (eh actually ada something yang i tgh buat ni haa.. hehe)... But hope to here some progress by next week Insya Allah..  
    Ok lets talk about the "SOMETHING" that I'm currently doing... remember on the day we went to the house and i ask En Hulk to get all the measurements of the house for me...hehe ok this is the reason of it...I have list down some of the major things that i want to do for this house..such as:
    1. Kitchen Cabinets with Island
    2. Wood Flooring
    3. Walk-in Wardrobe
    4. Washing Area
    5. Designer's Toilet
    6. Grills
    So that is the MAJOR things la... (ok ok No.6 jer kot yg aku rasa keperluan... lain semua kehendak..hehe) Fine lets talk logic then... 
     Basic things to buy:
    1. Lights
    2. Fans
    3. Pipe/Taps (including inlet & outlet)
    4. Shower
    5. Sink (rumah tu 1 toilet jer ader sink k! Yes, dpt jugak designer's sink!) 
    6. Hob, Hood & Oven (hehe sebab dah terbeli... 1 set RM3,399)
    7. Fridge (aaa ni belum beli)
     To build/reno/fix:
    1. Grills
    2. Fix all lights, fans, pipe, tap & shower
    3. Break Kitchen Wall (nampak besar sikit ruang kitchen tu)
    4. Extend Masterbedroom - Terrace Area (for walk-in wadrobe)
    5. Extend Living & Yard - Terrace Area (alang2 nk buat concrete work)
    6. Kitchen Cabinets & Washing Area (Yard) 
    7. Clean the Yard & put Awning  (probably lil bit of tiles and grass too)
    Once we have list down all the things we want to do and buy... now we have to do the ESTIMATION CALCULATION called BUDGET which i will peningkan my kepala next time... skrg nk layan gambar designer bathrooms...

    Lawyer's Deposit

    Date: 20 Sept 2011

    I receive an email from my lawyer saying...


    Dear Ms Gebera,
    i just contacted the Developer SYABAS PEMAJU (M) SDN BHD to immediately confirm on the status of this property i.e whether the Strata Title has been issued or not. According to the Developer, this project still under Master Title and the Strata Title has yet to be issued.

    On that very same day, Mr Agent called and told me that Mr Owner wanted to use his own lawyer pulak..,  Ms Owner's Lawyer . Mula-mula tu cuak la jugak... lama lagi la process membeli ni... bukan nak nak masuk sgt dah rumah tu pun.... tp al maklum la selagi xsettle hal pembelian ni selagi tu la rasa mcm jiwa xtenteram!!! kalau ikut hati lagi lama proses lagi bagus...lagi lambat potong gaji... ngeh ngeh ngeh... ok ok enuf of merepeking...ok according to my lawyer, its ok kalau diaorg nk guna lawyer sendiri..bcoz she will still have to prepare all the necessary documents.. the other lawyer will only need to vet through...bak kata lawyer ku... kita yg beriya nk beli umah tu...so kita la yg kena buat semua document...depa usha usha ja...hehe.. ai ai sir! 


    Oh ya finally! my lawyer have pass the quotation for S&P preparation to me and its about RM6k... deposit kena bayar dlm RM500 dulu... fuhh!

    Mr Agent came to my office to pass a copy of Mr Owner's Sales and Purchase Agreement (S&P) and Deed of Mutual Covenants. (beriya giler aku suh dia mengantor-nyer..bukan ape.. esok ni xyah nk p kt Burger King MRR2 tu lg just to pass some documents jer.. at least dia tau office i kat mana.. n boleh terus dtg sini)

    My colleague, Mr H inform me about his meeting with his lawyer fren and provide the lawyer's contact detail, Ms Lawyer. I went back to my place and immediately called her and she explains on the documents that she needs and I explains to her what are my plans and what i want her to do and so on.. basically what I want from her is the quotation and what she wants from me pulak for now are as follows:
    From Me
    1. IC
    From the Owner
    1. IC
    2. Sales and Purchase Agreement
    3. Deed of Mutual Convenants
    4. Previous Loans Approval
    5. Latest Cukai Pintu
    6. Latest Maintenance Fee
    7. Latest Water Bill
    8. Latest Electric Bill
    9. Income Tax No & File Location

    After a few survey done on Valuer... I have made up my mind to choose Ms Valuer, from WMMKJ. Reason: she AGREES with my pruchase price as well as her fee is reasonable which is RM424 ONLY :D
     
    So tanpa membuang masa lagi, i pun call Ms Valuer to confirm that i would like to appoint her as my Valuer and ask her to view the property (if possible) tomorrow (during PH - kesian dia). Then i call Mr Agent, to set the time with him as well, coz he has the house keys. (again during PH and he was suppose to to go Genting - kesian him too).

    Ok ok for some people (especially my sister, she will bebegging with her friend too change their dates so that she could work on a PH -> so that dpt triple pay) but not for my agent and valuer... BUT!! We (Me and En Hulk) have a good reason k... we wanted to go to the house again...so that we could do a few things which are...
    1. To get mails that is in the mailbox
    2. To check plug points, light points,water inlet & outlet 
    3. To take Pic/Video of uncertain areas
    4. To get En Hulk to measure certain parts of the house
      (mainly the kitchen, yard, masterbedroom & terrace)
       
    Senangkan ada org yg boleh measure sendiri xyah nk panggil contractor pulak...fenin nnt ramai2..hehe ok ok Yenneway, all this is for me to put in my Estimation Cost For Renovation Sheet that I've been working on for the past few days.... especially the kitchen cabinets... so when we have put in bids and pieces.. mahai jugak nk buat kitchen sekangkang kera tu...  

    Soo since its gonna take long process just for me to own the house key, thats y im taking this opportunity to do it right now. I want to have empel of time to think about my cabinets... i mean the details of it la...


    Date: 16 Sept 2011 (Hari Malaysia)

    Since we have decided to get all the mail that hv been stuck in the mailbox for the past 4 years, unfortunately, Mr Agent said, Mr Owner couldn't find the mailbox key. So Mr Agent and En Hulk try their very best to just pull what ever they can see or feel from the mailbox. As the result, they got an electric bil, indah water bill and management's slip for water bill.. ok lah tu... Caya lah En HULK!!!

    At the same time, I was showing Ms Valuer the house area,the extra land and the views (hillside view lagi u...). She was taking pictures, looking at each rooms writing down on plug points, tiles up till wall etc.. She also took the Management's Address and Contact number. She said she need to ask a few questions especially on the monthly maintenance rate... All the details will be list down in her reports..

    Ok back to the men pulak, after  sorting the mailbox, En Hulk, as planned earlier, took out his video camera and starting to record each walls, ceilings and floors just to know on the existing locations of the pugs and lighting and pipes... then once finished, he straight away measure all rooms including living and kitchen..... busy kan dia... me?? hehe... My Job is the most susah one... layan Ms Valuer... hehehe coz we forgot to bring our pen and had to lend her pencil... so kena la sembang2 so that dia tak boring sementara En Hulk menjalankan tugas dia dengan kalutnya....hehehe... Mr Agent?? Posing jer...sambil isap rokok.. (first time tgk dia isap rokok)...

    Ok lepas ni i akan cerita pulak why I n En Hulk dok kalut amik measurement awai2 nih...hehe Jeng Jeng Jeng....

    VaLueR..

    Who is Valuer?
    "Valuer is a professional who has been educated and trained to determine the value of fixed property, execute feasibility studies and provide expert advice on property related matters. The Valuer does not invent value, but interprets market forces, which determine the value. Valuer is a profession closely related to real estate. A Valuer determines the value of property based upon market conditions at a given time."
    Let me just drive you through the SIX (6) easy step of engaging a Valuer Service:


    STEP 1: Get SEVERAL Valuer Company Name, Location & Contact Number
    (Make sure it is the panel of the Bank that you are taking)

    STEP 2: Call SEVERAL Valuers, give your purchase price and ask for the Valuer's Fee
    (IMPORTANT: Make sure their offer [Market Value, MV] is equal / above your purchase price)


          Commonly Asked Question:
            (by the Valuer, during phone calls)

         1. Full Address of Property?
         2. How Old is the Property?
         3. Type of Property?
         4. Condition of the Property?
         5. Built-up Area?
         6. Price you are buying? 





    STEP 3: Choose the BEST Valuer 
    (You may want to SELECT the one that gives the lowest fees and agrees with your purchase price)

    STEP 4: House Viewing
    (Valuer's site visit - to look at the property and take lots and lots of photos)

         There are Two (2) options:

         1. You can set a date with the Valuer and the House Agent to 
              visit the property

             Advantages
              - You get to meet the Valuer
              - Opportunity to visit the property again
              - You can measure the size of your kitchen for renovation
                 estimation purposes

                 (Of course i pick this option :D )




         2. You can just give your House Agent's Name and HP Number
              to the Valuer.
              (The Valuer will contact the Agent and arrange to visit the
              
    property themselves.)




    STEP 5: Valuer ON DUTY! 
    (Valuer will prepare all necessary documents and value the property)

    STEP 6: Collect Documents & Pay Valuer Fees
    (Once the document is ready, the Valuer will contact you for collection and payment)

          Payment can be made via:
    •  Bankers' Cheque
    •  Bank In Account
    •  Cash

    SeaL 'z DeaL

    Ok after a Long Long Long thought about the house.... and after confronting Many Many Many people (family and friends) i have made up my mind....


    FINAL RESULT : TO BUY THE HOUSE!!!

    So, i've meet up with the agent to seal the deal... before Mr Owner change his mind and mark up the price...so me and En Hulk (bukan nama sebenar) meet up with Mr Agent at Burger King MRR2, at 9pm paid RM1k... Masa on da way nak p bayar tu... Allah jer la yang tahu betapa sejuknya tangan i ni... macam la nk p bayar berjuta2...hehe.. 

    Tp petang sebelum tu dah ada story mory the morning glory... actually i yg patut bayar the deposit.. im suppose to get my money by today...tp ada la masa-elah yang xdapat dielak-kan... so En Hulk pun dengan rela hati-nya meng-offer-kan diri untuk membayar duit muka...(wahhh syahduu-nya rasa..) Yes at least nampak like he make the first step right... ini la dikatakan ketentuan ditangan tuhan... ada hikmah disebalik sesuatu yg berlaku... n this is the main reason why i didn't got my money... oh well so the deal has been sealed!!

    N now i can go back to Penang to celebrate Hari Raya peacefully.... 

    But on the raya eve, Mr Agent told me that Mr Owner will wait till i pay the full amount of 3% (deposit) then only will he signed the deposit receipt. Oh well, as long as u don't mark-up the price, it's fine with me... RAYA MOOD ON!!

    Discuss with one of my colleague, Mr H about choosing Bank's Panel Lawyer. I thought of appointing the same lawyer to do my S&P as well as to deal with the Bank. That's y I need a list of Bank's Panel Lawyer.. Luckily he has a fren who is also one of the Bank's Panel Lawyer. So i explain to Mr H about my plan and financial issues... meaning my planning on paying n etc.. so he said don't worry, he will meet his fren first and will inform me soon.. he even said that he could ask for a discount with this lawyer....YEAY!!. Fuhh 1 part settled!

    Meet up with Mr Agent again at Burger King (mesti mamat2 kat burget king ni dah kenal kitaorg..hehe... tp kitaorg beli air k bukan duduk saja)  at 10pm to pay remaining balance from the 3% amounting of RM6,500 (bankers' cheque). I also add in a special condition saying that the remaining 7% will be paid using my EPF withdrawal upon signing of S&P as well as Approval of Loan.

    Mr Agent called to informed that Mr Owner have signed the deposit receipt. Meaning that he has agreed with the amount of RM250k.

    Alhamdulillah...that is such a GREAT NEWS!!!

    NEXT STEP:
    1) To get a valuer 
           (with cheaper rate - p/s: we can bargain)
    2) To meet up/call with the lawyer (Mr H's fren)

    That is the main question which has been bordering my mind for the past few weeks...


    so this is how the story starts....


    Once a upon a time, in a far far away land and up on a hill, there's this unique house area thats been found and it is called Andari Town Villa.


      
    The house is situated in Selayang near to Templer Park or right behind Majlis Perbandaran Selayang. Hopefully its a good signed...hehe. Back to the story, the house is kind of an apartment with an extra land (for lower floors) or some might call it as a townhouse. But since it has been clearly define in its name, so i think we should just stick to TOWNVILLA.. It is a gated area with 24hours guard, with also a club house that consist of a Nursery, Gym, Swimming Pool, Children's Playground and Mini Market (that sells gas.. selamat! coz its kind of difficult if we hv to go out from the area just to get a "TONG" of gas and then hv to carry ourself to the house..) ok where was i... ahaaa... 1 Covered Car Park and a proper garbage disposal area (Far far away from the unit that i like!)... ok enuff about the facilities, now about the unit that i've fall in love with... 

    Ok as i said earlier, the house is on a hill.... a SMALL HILL... and facing the HILLS....

    It is a corner lot at the lowest floor (L2) with an extra land that no one can access to instead of the owner. so it can also be called as a PRIVATE EXTRA LAND :)

    Haaaa tudiaaaa bak kata org Penang... Anyway, the Build up of the House is 1098 sqft, whereas the Extra Land is 2067 sqft which brings a total of 3164 sqft. As for now no construction can be done on the land.  But once we get the title we can even build a house on the land...hehe

    1) Cheap 
         Market Value is about RM300k, i got it for RM250k
    2) Landed property with Security Guard
          The extra land can be turn into a nice garden or extend into other space or rooms.

    3) Location - Near Commercial Area
          There's TESCO, MYDIN, all Banks, Pasar Borong and also 20 mins to Town.

    4) Environment
          Cool area and peaceful with nice view - hills..

    CONs
    1. Stairs.. have to go down 3 floor (G >>LG >>L1>>L2) because its at level L2
        But if we stay in a double-storey house, the frequency of using the stairs is more than this.
    2. House Gate... looks like not so safe...
          Need to put alarm and sensored light
